Renting in the Netherlands: contract, deposit and rent checks

What Dutch law says about written contracts, deposits, the points system and the Rent Tribunal, and how to check your rent in the first six months.

This is orientation from city and expat-centre pages, not legal advice. The pages we read do not state the deposit return deadline, the rent-increase rules or how the social, mid and free sectors are defined.

Rent Tribunal and its limits

The Huurcommissie is an independent government body that handles disputes over rent levels, maintenance and service charges. Its decisions are binding, and it can order a landlord to make repairs or reduce rent where living conditions are affected.

Amsterdam notes that the Rent Tribunal has no jurisdiction in the private sector, where only a court can rule. Amsterdam also says you can seek its help if the basic rent exceeds the social-housing maximum but should fall within the social-housing threshold, within the first six months of the contract.

Eviction and rent protection

A landlord cannot simply evict you. Only a court can end a lease after a conflict. Dutch law also sets rules on rent control, furnishing and service costs, and housing agencies can be held accountable for overcharging.

Contract and administration expenses can often be disputed.

What this guide does not cover

The pages we read give no deposit return deadline, do not describe rent-increase rules or temporary contracts, and do not define social, mid-segment and free-sector rents. Check the Rent Tribunal website or your municipality’s rent team for those.

For registering at your new address, see the BRP and BSN guides, including the guide for arriving without a rental contract.

Common questions

How much deposit can a Dutch landlord ask for?

Not more than two months’ basic rent, according to The Hague International Centre. Amsterdam says three months is unreasonable.

Does a Dutch rental agreement have to be in writing?

Yes. Under the Good Landlordship Act, in force since 1 July 2023, the agreement must be in writing.

What is the points system?

A national system that scores a home on quality, size, location and facilities. The total sets the maximum rent, and landlords must give a written points system with contracts signed from 1 January 2025.

How long do I have to challenge my rent?

Request a rent check within six months of the contract start date. If the rent is too high, the reduction applies from the start.

Can a landlord evict me on their own?

No. Only a court can end a lease after a conflict.
